In this case we are asked to reverse the judgment of the District Court dismissing the original complaint and denying leave to file a proposed amended complaint.

The complaint, filed May 17, 1941, shows the existence of diversity of citizenship and the requisite jurisdictional amount, and seeks a partition of the premises described and an accounting for rents. It alleged that on July 24, 1925, one Mary L. Walker conveyed to plaintiff...
