In the above case a motion has been made to vacate the order permitting the original defendants to bring in Anna Malkin as a third-party defendant. The motion raises several interesting questions arising on the application of rule 14(a), Federal Rules of Civil Procedure, 28 U.S.C.A. following section 723c.
