This action was brought by the plaintiff under the Act of Congress, 29 U.S.C.A. §§ 201-219, and known as the Fair Labor Standards Act of 1938.

It was alleged that when this Act went into effect, on the 24th day of October, 1938, the plaintiff was employed by the defendant at a rate of one dollar per day, of twelve and one-half hours, seven days per week, as a night watchman in a lumber yard near Summersville, in the County...
