In 1934 one of the appellees, Percy W. Matthews, a mechanical engineer, was the originator of three devices which he wanted to exploit. These consisted of a four-high rolling mill, a flying shear and a heat controlling device. By August, 1934, he had filed applications for patents on the first two devices and was in the course of preparing an application for a patent on the third.
