The plaintiff Stearns Coal and Lumber Company brought this action to recover of the Collector of Internal Revenue for the Western District of Kentucky the sum of $2,655.67 with interest, which it alleges was erroneously paid by it as income taxes for the years 1936, 1937, 1938 and 1939.
