Herein the plaintiff complains that before his appointment as administrator of the estate of Simon T. Douglas, deceased, which occurred on April 4, 1935, and before the appointment of any administrator or executor whatsoever, and after the death of said Simon T. Douglas, which took place January 12, 1935, the defendant, on or about February 5, 1935, wrongfully took into its possession, sold, alienated, converted and disposed of to its own use...
