This is an action in trespass brought by Cornelius Boyle and his wife, Ethel Boyle, against Louis N. Ward, to recover damages for personal injuries sustained by Mrs. Boyle on April 6, 1939, when the automobile in which she was riding, driven by the defendant, upset on a highway in New York State, between Binghamton and Sidney.
