This action is for an alleged infringement of copyright. The matter now before the court is defendant's motion to dismiss.

The plaintiff is the widow of Harry J. Stuff, who died in Kearney, Nebraska, on February 4, 1938. Some time prior to June 24, 1914, said Harry J. Stuff and one Wilson originated the pictorial illustration which is the subject of this suit. The picture is of a boy, with a broad, vacant smile revealing a missing front...
