White, the accused, was convicted along with four other persons and two corporations of using the mails in a scheme to defraud, § 338, Title 18, U.S.C.A. § 77(q), Title 15, U.S.C.A. and of a pendent conspiracy to commit the same crime, § 88, Title 18, U.S.C.A. The gravamen of the charge was the use of the mails for the distribution of certain prospectuses for the sale of shares of "Class A" stock in the Bankers Industrial Service...
