The above entitled cause arises out of the Federal Firearms Act of 19381. An original indictment2 was returned on November 15, 1938. A petition to suppress evidence on the grounds of unconstitutionality of the statute and illegality of the search was filed by the defendant on December 1, 1938, and was denied on August 14, 1939.
