Appellant was convicted on an indictment containing five counts, charging a wilful attempt to evade and defeat income taxes due the Government for the calendar years 1934, 1935, 1936, 1937 and 1938, inclusive. The indictment charges that the total net taxable income received by appellant during the period of five years covered by the indictment was $83,550.16, whereas the total net taxable income as reported by him was $17,627.55.
