This is an appeal from a judgment against appellant, as surety on a depository bond. The funds sought to be recovered were deposited and the default occurred after the depository and another bank had been merged into a new corporation. The suit was removed to the District Court on the ground of diversity of citizenship. The facts are all stipulated.
