This appeal is from a judgment of the United States District Court in Rhode Island entered after a jury verdict.

It appears from the evidence that in January, 1933, Ferro Concrete Construction Company, appellant, made a contract with the United States for the construction of a public building at Newport, Rhode Island, and gave the bond required by the Hurd Act.
