The plaintiff entered into a life insurance contract with the defendant on August 16, 1929. In 1932 he claimed to have become totally and permanently disabled. This was recognized upon physical examination, without suit, by the defendant company in 1933. The result to the date of institution of this suit has been that the defendant company has paid plaintiff $20 per month for five years, then $30 per month for a period of twenty-five months...
