This case is before the Court for determination of a motion to dismiss the Complaint because it fails to state a cause of action upon which relief can be granted.

The Complaint alleges that the Plaintiff is the administrator of the estate of Bernard J. King, and that said Bernard J. King had applied for and was granted a policy of War Risk Insurance in the sum of $10,000; that Bernard J. King was permanently disabled on April 10, 1919...
