This is an appeal from an order dismissing a writ of habeas corpus taken out to release the bankrupt, Rose, from imprisonment. In July, 1933, one Hamburger obtained a judgment against Rose in the Municipal Court of the City of New York, and on the 12th day of August, 1938, he served upon Rose an order of the City Court of New York in proceedings supplementary to execution. On the 29th day of October, 1938, Rose filed a voluntary petition for bankruptcy...
