This appeal is from a judgment dismissing a complaint, for failure to state a valid cause of action.

Plaintiffs sought to recover a money judgment for damages occasioned by alleged fraudulent representations in the sale of a note and mortgage. The president of the defendant bank represented to plaintiffs' mother that the mortgage was a first mortgage on property worth more than the indebtedness, when it was, in fact, a second mortgage, and the first mortgage secured...
