The two defendants were indicted in separate indictments which are identical and are based upon the Selective Training and Service Act of 1940, 50 U.S.C.A. Appendix, § 301 et seq.

The indictment in each case charges the defendant with evading the requirement of the act in refusing to register in the land and naval forces of the United States at the time and in the manner prescribed in the act, and the rules and regulations made...
