ATWELL, District Judge.

Henderson McCrary, the husband of Lois McCrary, and the father of the minor children, who are defendants in this case, was an employee of an employer insured under the compensation laws of Texas. While in the regular course of his employment, on March 13, 1939, he was injured by a motorcycle operated by one R. W. Nichols, an outsider. On April 1, 1939, he settled with that person for $350.
