GALSTON, District Judge.

The libellant was a passenger on the steamship Pan America on the voyage from New York to Brazil. She alleges that on or about July 13th, 1936, while she was sitting in a deck-chair, a hot piece of burnt paint or chip struck her right eye at a time that one of the members of the crew was chipping or burning paint with the aid of a blow torch on the accommodation ladder.
