Plaintiff in this case recovered a judgment in the Circuit Court of Alleghany County, Virginia, against the original defendants for injuries received in an automobile accident. Execution on this judgment was returned unsatisfied, whereupon plaintiff instituted a garnishment proceeding against the Maryland Casualty Company, based upon an alleged liability policy issued by the garnishee to these original defendants, Kelley and Blankenship.
