Jackson County, Missouri, sued The Alton Railroad Company in two law actions which were removed on the ground of diversity of citizenship, consolidated for trial and tried together. At the close of the plaintiff's evidence the defendant railroad company "offered peremptory instructions" and after argument the court indicated his desire for time to consider the same.
