Plaintiff filed suit against the defendant insurance company in a state court, and upon motion of the defendant the suit was removed to the District Court of the United States for the Eastern District of Wisconsin. Plaintiff sought to recover upon an "accidental death" clause in a policy in which plaintiff's deceased husband was the insured.
