On March 5, 1937, appellant, plaintiff below, demanded of the appellee, defendant below, the payment of $25,000 authorized and directed to be paid to the estate of Teresa de Prevost by S. 1360, which had been passed by the Senate and House of Representatives, enrolled, and presented to the President of the United States on May 25, 1936, pursuant to clause 2, sec. 7, art. I of the Constitution of the United States.1
