JOHNSON, District Judge.

This is a motion by the defendant for a new trial and in arrest of judgment. The action was brought to recover the permanent and total disability benefits under a war risk insurance policy issued to plaintiff by the defendant. The case was tried before the court and a jury and a verdict was rendered the plaintiff, finding him permanently and totally disabled since June 25, 1928.

The sole question involved is whether the evidence warranted...
