This suit was brought to recover disability benefits under a contract of war risk term insurance which afforded protection from September 7, 1918, to January 31, 1919. Plaintiff relied upon maturity of the contract during the life of the policy by reason of disability incurred in December, 1918. Defendant's case on appeal turns entirely on the proposition that there was no substantial evidence that plaintiff became totally and permanently disabled...
