BURKE, District Judge.

The petitioner, a prisoner at the Attica State Prison, seeks his release by habeas corpus. He was convicted January 21, 1930 of grand larceny and sentenced to prison for not less than three nor more than ten years. On July 1, 1932, he was released on parole. With the consent of the Parole Board he went to Detroit, Michigan, and later to Cleveland, Ohio. In April, 1935 he was re-taken as a parole violator, declared delinquent by the Parole Board...
