After the reversal of his judgment,1 plaintiff Murphy sought, by tendered amendments, to carry on the litigation in the reversed cause upon new pleadings; the defendant City sought, by motion in that cause, to have the costs taxed in its favor. Leave to file the amendment to further litigate was on January 4, 1937 denied, upon the ground that our reversing decision and opinion, "definitely and finally decided...
