This is an appeal from a judgment discharging Mosheik upon habeas corpus.

Mosheik was convicted in the District Court of the United States for the Northern District of Texas of violations of title 18 U.S.C.A. § 73, and on December 19, 1931, was sentenced to imprisonment in the United States Penitentiary at Leavenworth, Kan., for a term of seven years.
