In the court below (18 F.Supp. 971) the appellee, hereafter called Bank, brought suit against appellant, hereafter called Surety Company, upon the latter's indemnity bond. Jury was waived, and the case tried by the judge, who found against Surety, by whom this appeal was taken. In deciding the case, the trial judge so fully discussed the facts and law that by reference thereto we avoid needless repetition...
