In this case the plaintiff (appellant) John A. Lyons, brought suit against the defendant (appellee) Liberty National Bank, to recover the sum of $1,500.00, together with interest and costs, which sum it was alleged had been wrongfully paid out of escrow. The defendant admitted the deposit of the fund in escrow and the payment out, but asserted that the latter was made according to the terms of the escrow. The case was tried to a jury....
