The tract of land described in section 1 of the complaint was conveyed by deed, known as the Sibbald deed, dated August 14, 1880, from William Johnston and others to the Commissioner of Indian Affairs of the United States, as trustee for the Eastern Band of Cherokee Indians, it being the eighth tract as described in that deed, which was duly recorded...
