This is an equity suit to establish a trust and require an accounting. The ultimate issue concerns the construction of a will. In 1887, Thomas S. Rutherfurd died domiciled in Missouri. He left a will, which was duly probated, in which he made provision for his wife and children. His wife, however, died before he did so that the provisions of the will relating to her need not be considered. At his death he had six children of whom one was Adele, the wife...
