The defendant moves to strike from the record the motion of plaintiff for new trial upon the grounds: First, that the motion was not made in accordance with rule 75 of this court and within the time provided for in said rule; and second, that the motion for new trial is argumentative and does not state any facts entitling the plaintiff to a new trial.
