Ferguson & Co., a corporation, petitioned the bankruptcy court to compel the trustee in bankruptcy of the Lincoln Trust Company to turn over to it a note and mortgage valued at $7,000.00 then in the possession of the trustee in bankruptcy among the assets of the bankrupt estate and referred to in these proceedings as the Spurrier mortgage.
