This is an appeal by the plaintiff from a judgment of January 21, 1936, of the District Court for Rhode Island in favor of the defendant.

The plaintiff brought an action at law against the defendant in the superior court for Rhode Island, and the same was thereafter removed to the federal District Court. After removal an amended declaration was filed in which it was alleged in substance that the Graver Tank & Manufacturing Corporation...
