By various agreements the Temple Coal Company became the lessor and the Lehigh Valley Coal Company the lessee of a certain anthracite mine known as the Babylon. This action is by the receivers of the Temple Coal Company to recover $75,000 from the Lehigh Valley Coal Company for failure of the latter to pay royalties on coal mined in the Babylon mine and for lack of diligence in mining.
