A number of questions are involved in this case, mainly growing out of the validity of certain subordination agreements entered into by the various state banks, of which plaintiff Schmitt is receiver. At the time of the trial it appeared that the subordination agreements as alleged in the complaint, in so far as they applied to the Bank of Nevada Savings & Trust Company and the Virginia City Bank, were not produced.
