The branch of the above case under consideration involves merely these questions: (1) Is Rogers Caldwell, as trustee, under the deed of trust from Ralph F. Hicks, John Wesley Hotel owner, entitled to a fee; and, if so, what is the amount thereof; and, further, is he liable for the loss of $7,652.87, which was on deposit in the Bank of Tennessee at the time of its failure; and, if liable, should this amount be offset against any fee allowed...
