Plaintiffs below, appellants here, own street improvement bonds, issued in 1921, of a face value of over $80,000, which are due and unpaid. The statutes authorized the levy of assessments on land specially benefited and the issuance of bonds to pay for the improvement, such bonds however to "be payable out of the local improvement fund created for the payment of the cost and expense of such improvement...
