This is a return to a writ of habeas corpus. The relator, Nathan Fink, has been ordered deported and now petitions for his release.

The following facts are not disputed: In February, 1927, the relator, a citizen of Poland, secured from the American Consulate at Warsaw a preference quota immigration visa under the name of Markus Apfelroth.
