This is an appeal from an order of the lower court overruling a demurrer to appellee's answer to appellant's amended petition, dismissing the petition, and discharging the rule to show cause issued thereon.

It appears by the amended allegations of the petition and the answer filed in the lower court that on and prior to July 15, 1933, appellant was employed in the Bureau of Internal Revenue as a duly qualified, classified civil service...
