This is a prosecution under the mail fraud statute, 18 USCA § 338. Of the two defendants, Griffith was acquitted and Vann was convicted. In support of this his appeal, Vann argues that the scheme alleged, assuming that it was fraudulent, had been accomplished and was at an end before the mailing of any of the letters which the indictment charges were mailed in execution of it.
