David Lamson, the accused, is charged with having murdered his wife, Allene Thorp Lamson, in the county of Santa Clara, on May 30, 1933. He has twice been tried in the state court. In the first prosecution he was found guilty, but the Supreme Court of the State of California reversed the judgment of conviction and remanded the case for a new trial. People v.
