This is a suit at law brought by the appellant, receiver of the Holston-Union National Bank of Knoxville, Tenn., under section 91 of 12 USCA, to recover from the appellee an amount paid to him on his check by the bank the day before the bank was placed in the hands of the Comptroller of the Currency for liquidation.
