The suit is by the owner of a steamer against the charterer, for damage to the hull caused by resting on bottom while at a berth.

The libelant owned the tank steamer Halo. On June 27, 1928, it chartered the steamer to the respondent. In the charter party the Halo was represented to have a capacity of 75,000 barrels of oil, 10 per cent. more or less.
