PHILLIPS, Circuit Judge.

On August 27, 1918, the Secretary of Interior approved a departmental oil lease from the Osage Tribe of Indians to the Osage Oil & Refining Company. This lease was for a term of five years from the date of approval, and "so long thereafter as oil is found in paying quantities." It has been the subject of much litigation.
