Appellee, as administratrix of the estate of her deceased husband, filed this suit to recover for his death under the Federal Employers' Liability Act, 45 USCA § 52. The deceased was in the employ of appellant and it is alleged in the petition and was shown by the evidence that both he and appellant were engaged in interstate commerce at the time of the accident. There was a trial before the court and a jury which resulted in a verdict...
