In this case the defendant has filed a motion for a new trial praying for dismissal of the petition herein on the principal ground that the court erred in holding that a waiver executed by John W. Kieckhefer in his own name and in the name of the dissolved corporation by himself as a former director thereof was not a valid waiver under the statute.
