The petitioners for writs of habeas corpus filed on January 2, 1934, were about December 14, 1933, and without a warrant of arrest or a charge being filed against them, taken into custody of the defendant as sheriff of Ada county, Idaho, and have since then been confined in the jail of the county until the 4th day of January, 1934, when a warrant was issued out of the probate court of the county commanding the defendant to arrest the petitioners...
